This was Halloween fun for the whole family. I found this was a car lovers event with 220 entries of classic cars. The tarmac was filled with shiny, reasonably new antique cars. Some vehicles were in the hangars next to vintage planes. Seeing the cars and aircraft together gave visitors a lot to enjoy. History coming alive. The cars showed the owners’ love for their vehicles by the way they shine and are displayed. Awards were given in several categories, like age and sponsor choices. Power Pop, Americana and ‘The Killer’ Celebrated

An outstanding new album from power pop hero Richard X. Heyman along with a timely reissue from singer-songwriter Chris Berardo are featured in my column this week. I also pay tribute to rock and roll great Jerry Lee Lewis who passed away on Oct. 28.

A truly gifted singer, songwriter and multi-instrumentalist, Heyman writes songs that are never less than interesting and literate while simultaneously reaching greater heights via luxurious sonics that recall some of the genre’s greats from the 1960s, ‘70s and more recent times. Tell me more: Back in 1997, New York singer-songwriter Chris Berardo recorded his debut album titled American Dust. Now the under-the-radar disc has received a welldeserved re-release on the occasion of its 25th anniversary. The album’s delights are obvious

a quarter of a century after Berardo completed the tracks. The title track is an infectious and uptempo Americana-styled rocker. The lovely atmospheric acoustic ballad “She’s Leaving Me,” reflective country-flavored “Old Man’s Eyes” and “The Top Of The Stairs,” rousing roots rocker “One Step Closer To Goodbye” are among the other standouts on the solid album. Berardo continues to write, record and perform and has several upcoming November dates in Texas and New York. Jerry Lee Lewis

Remembered Rock and Roll icon Jerry Lee Lewis passed away at the age of 87 on Oct. 28, 2022. With the passing of “the Killer,” the Rock & Roll Hall of Fame has sadly lost its last inaugural inductee. Back in early 2000 I was a contributing writer for The Orange County Register and assigned to cover Lewis when he headlined at the Galaxy Concert Theatre in Santa Ana, CA. Here is my review of that show. A special “thank you” to Kelly A. Swift, who took the photograph at that concert. Following is my review of that March 1, 2000 event:

Although rock music is somewhere under age 50, its pioneers are mostly gone. The voices of Bill Haley, Elvis Presley, Eddie Cochran and Roy Orbison live on only through the magic of recordings. However,

one of rock’s true survivors proved to be alive and well in an hour-long performance at the Galaxy Concert Theatre in Santa Ana on Wednesday night. Jerry Lee Lewis may walk — and talk — like a senior citizen being satirized, but get him behind a grand piano and he is transported back in time to the birth of rock ‘n’ roll.

Such was the case throughout his 16-song set before a capacity crowd at the Galaxy, where — backed by a solid three-man band — the so-called “Killer” displayed plenty of fire.

Although Lewis didn’t perform standing up, climb all over his instrument like he has for much of his career, the music-making itself provided

plenty of opportunities to celebrate his living legacy.

The Louisiana native launched things with a roaring version of Chuck Berry’s “Roll Over Beethoven,” his vocals confident and fingers nimble as he fired off the boogie-woogie style that has been imitated by countless blues and rock players since the mid-1950s.

There was a slow and sparse rendering of “Somewhere Over the Rainbow,” a runaway take on the classic “Sweet Little Sixteen” and his own classic “Whole Lotta Shakin’ Going On.”

And “Great Balls of Fire” remains an exuberant celebration of youth, even in the dancing hands of the 64-year-old Lewis.

DHS Schools campuses cleanup

– The Desert Hot Springs

Beautification Committee will host a two-school cleanup on Saturday, Nov. 5th starting at 8:30 a.m. at the Painted Hills Middle School and Bella Vista Elementary School.

Teachers, parents, students, and city volunteers will pick up trash, sweep sidewalks,

rack leaves, and perform other general cleaning on and around both school campuses. The event should last about two hours with water, juice and healthy snacks provided by the city of Desert Hot Springs.

The committee has joined with the principals of the two schools to educate their students about the importance of keeping their city clean. This

is a pilot program that hopes to partner with other local schools throughout the coming year.

This is the first cleanup event of the newly reorganized beautification committee which has redirected their focus from the cleanup of empty lots to helping residents and businesses beautify their homes and storefronts.

and Councilman Roger Nunez, along with Compliance Manager Christina Newsom lead the beautification committee with residents James Nindel and Jackie Devereaux organizing this event.

The city has committed $500,000 towards the beautification project which expects to paint houses, fix windows and roofs, along

with sprucing up signage and business storefronts. The city’s code enforcement department will help choose which businesses and homes will be approved for repairs. Each home and business will get about $10,000 each towards their beautification project. The $500,000 comes from the American Rescue Plan Act and the Housing Authority.

Advocates Press for Changes to CA Lead Pipe Program

October has been Children’s Environmental Health Month and this week is National Lead Poisoning Prevention Week, so groups in California that advocate for children’s health are asking for changes to the state’s 10-year plan to replace lead pipes.

California could get up to $1.25 billion from the infrastructure bill to replace old lead water lines.

Kelly Hardy, senior managing director of health and research for the group Children Now, said a coalition of health and environmental groups has written a letter asking the California State Water Resources Control

Board to “get the lead out.”

“We’re pushing that they use all the available funds to replace all of the pipes and to add filters so that there’s not an increase in lead in the water when the pipes are being replaced,” she said, “and also provide for a systematic sampling of the water.”

In a statement, the water board said that to receive funding, water agencies must replace the entire lead line and provide filters and testing. In addition, agencies have two years to inventory lead in utility-owned and customer-owned service lines. The state Division of Drinking Water has inventoried more than ten million water lines and found almost 11-thousand lead fittings but very few lead pipes.

Dozens of water agencies are currently replacing fittings. Hardy wants families to be notified when pipes upstream are undergoing work because just disturbing galvanized pipes to replace them can cause a spike in

lead levels in tap water.

“We know that there’s no amount of lead that’s safe for kids,” she said, “and it can cause a whole host of problems: learning disabilities, impaired hearing, hyperactivity, delayed puberty, and other health

and behavioral effects.”

Maps from the California Department of Public Health show the Humboldt, Merced, Sacramento, and Santa Cruz areas report high levels of lead in children’s blood compared with other regions of the state. In addition,

people can contact their local water district to ask for data on lead levels in the water and lead-abatement efforts.

“There was rockabilly. There was Elvis. But there was no pure rock ‘n’ roll before Jerry Lee Lewis kicked in the door,” Lewis once said of himself.

In his personal life, he raged in a way that could mean the end of his career today - and almost did at the time.

In 1957, while Lewis was on tour in England, the press learned that he married 13-year-old Myra Gale Brown. He was 22 years old. And SHE was his cousin on top of that!

His tour was canceled, he was blacklisted by the radio, and his earnings plummeted to virtually zero overnight.

The pianist, known, among other things, for the classic

“Great Balls of Fire,” died at 87, as his agent announced on Friday. He died of natural causes on Friday morning.

Lewis was the last survivor of a generation of seminal artists like Elvis Presley, Chuck Berry, and Little Richard.

His representative Zach Farnum said in a statement that he died at home in Memphis, Tennessee.

Few of the rock rebels who emerged in the 1950s embodied the allure and danger of the new genre

as unforgettable as the Louisiana-born pianist who dubbed himself “The Killer.”

It was best to leave tender ballads to the old

people. Lewis was all about pleasure and satisfaction, with his lascivious tenor voice, demanding quips, cocky grin, and crazy blonde hair.

“I probably would have lived my life a little differently, but I’ve never hidden anything from people,” Lewis told The Wall Street Journal in 2014 when asked about his marriage. “I just got on with my life as usual.”

‘Tis The Season – For Signs

Kelly: I am currently disagreeing with my HOA regarding political signs. I still have a small sign in my front yard. The HOA board inserted a new rule section referencing Civil Code 4710, and it states political signs cannot be placed more than 60 days before the election and must be removed 15 days after the election. Can the board bypass the DavisStirling Act with this new rule? Sincerely, M.R., Menifee.

Hi Kelly: About a month ago political signs for in the upcoming election started appearing in front yards. In the past the HOA required the resident to remove the sign. Now the HOA is citing Civil Code 4710 as a reason they cannot prohibit political signage at all. Can the HOA allow political signage only

during specified time periods? Has the HOA opened itself for litigation by not enforcing their own rules? J.R., Corona.

Dear M.R. and J.R.: Civil Code Section 4710 does not give political signs less protection than other noncommercial signs. I understand the logic behind the desire to limit political signs to the political season. However, the statute protects all noncommercial signs and banners, which includes the political variety. I don’t think a rule limiting the time for political signs would withstand a legal challenge. Although, I think good neighborly courtesy would dictate that outdated political campaign signs be taken down after the campaign is over, but the Davis-Stirling Act does not require that reasonable and neighborly behavior. Kelly: I have been doing battle with the HOA about a

resident displaying a “Black Lives Matter” sign in what is considered to be part of the “common area”. I petitioned the board many times to act on this, but they have shown no progress. Where do you think I stand? Thanks, R.M, Cardiff.

Dear R.M.: The Civil Code Section 4710, protecting noncommercial signs, limits its protection to signs placed with a member’s “separate interest.” “Separate interest” is defined by Civil Code Section 4185(a) as the “unit” in a condominium project or the “lot” in a planned development project. So, signs are not protected if they are placed in common area or exclusive use common area, which are shared interests and not separately owned by the homeowner.

However, is the sign truly in common area? The demarcation of common area as opposed to separate interest comes from the condominium plan in a condominium project and

a subdivision map in most planned developments. That differentiation isn’t as easy these day to identify as it used to be, since subdividers often create condominiums with “units” that include yards and other developers create planned developments in which the residences are attached and the “lot” is only the ground under the residence. CA Older Voters Expected to Dominate Midterm Election

Early in-person voting starts this Saturday in dozens of counties across the Golden State, and this year, older adults are expected to have outsized influence at the ballot box.

Data from the Public Policy Institute of California has shown that older voters make up the most significant share of high-propensity voters. So, Luis Campillo, Los Angeles regional director for AARP California, said this population segment will likely decide the election.

“Californians 55 and older make up about 34% of the state’s adult population but constitute about 47% of likely voters,” he said. “Whereas those between 18 and 34 make up about 32% of the population, only 23% of the likely voters.”

On Nov. 8, the ballot will contain multiple statewide initiatives on a wide range of issues, including health care, access to sports betting, flavored tobacco products, taxes, climate change, investments in art and education, and more.

Many local and regional measures touch on funds for affordable housing, parks, and community colleges. That’s in addition to the contests for governor, the U.S. House, and Senate, plus state and local offices.

All registered voters should have received a ballot in the mail. Campillo noted that the deadline to register for a mail-in ballot has passed, but fear not - because California has same-day registration.

“People can still register conditionally and vote,” he said, “so that just means that

you will cast your ballot, and it will be counted after the election office goes through the verification process.”

Advocates Push CA to List Joshua Trees as Endangered Species

The California Fish and Game Commission delayed the decision again today over whether to grant state protection to the western Joshua tree.

The petition to protect the plant under the California Endangered Species Act (CESA) was submitted in 2019. It would be the first species to earn protection in the state because of climate change if it is listed.

But the process has been contentious. And even when the decision is made, the plant’s fate is far from sealed.

HOW TO SAVE A TREE

Public members must make a case to the California Fish and Game Commission that a species needs protection. In this case, the point is over the western Joshua tree, which primarily grows in California.

Their champion is Brendan Cummings. As conservation director for the Center for Biological DiversityCenter for Biological Diversity, he’s litigated many endangered species cases. “Fifteen years ago, I did the ... litigation that forced the Bush administration to protect the polar bear under the Federal Endangered Species Act.”

But this species is personal. He’s got dozens of them in his backyard in the town of Joshua Tree. “If you look around us here, the adult Joshua trees we’re seeing were recruited into the population under a climate that no longer exists,” he says.

But the case he’s making isn’t easy. Millions of these trees are still spanning

thousands of square miles. Listing a species means businesses and residents must either avoid killing it, move it, or pay a fee if it must be destroyed. With so many trees left, that could be burdensome.

Kelly Herbinson says it’s worth the trouble. She’s the co-executive director of the Mojave Desert Land Trust, whose whole mission is to set aside acres of desert habitat for preservation.

“What we’re seeing right now is unprecedented. This is serious. And I don’t know that that’s always obvious if you’re not doing this every day and working on the land every day,” she says.

At lower elevations, the western Joshua tree is facing the effects of the worst drought in more than a thousand years. “If you were to go to, say, the West Mojave, or even areas nearby where the drought has been terrible, I mean, they’re mostly brown,” she says.

In its middle elevations, the Joshua tree has been separated into small island habitats by decades of development as the human population in the desert continues to grow. That cuts off genetic flow between populations and creates problems like what LA’s mountain lions are facing.

And then, of course, the Joshua tree faces a threat it rarely encountered before at its middle and higher elevations: increased wildfire.

On a protected parcel of land across the street from where Herbinson works, a stray cigarette in 2020 burned most of the Joshua trees on a quarter of the 600 acres

that the Mojave Desert Land Trust saved from becoming a housing development.

“That is not something that happened historically,” she says. “There’s this massive overgrowth of invasive plant species that are blanketing the desert and creating this massive fuel load. And then it dries out because we’re in a drought. And then you just have this carpet of dried-up plants that are ripe for burning.”

There’s also the problem of the tree’s lifelong partner: the yucca moth. They’re completely reliant on each other to survive.

The moth lives underground at the base of its tree for years, waiting for it to flower, and in the spring when it finally does, it emerges and pollinates the tree in exchange for food and a safe place to produce larvae.

But as the climate changes, scientists have found that the moths aren’t reproducing like they used to.

The California Department

of Fish and Wildlife spent months studying the trees. Their job is to provide all the data and expertise the commission needs to decide.

In June, the department determined that there isn’t compelling evidence that the western Joshua tree is in danger of going extinct in the foreseeable future. Instead, it said the plant has time to adapt to climate change.

Almost all of the peer-reviewed scientists disagreed. At the June meeting, hundreds of public members showed up to throw in their opinion too.

Local politicians, the local water board, building developers, and labor unions all argued that listing an abundant plant in the desert as endangered would hurt development and jobs.

National politicians, conservationists, scientists, local residents, and tribal groups all made the case that the western Joshua tree is disappearing and needs to be protected.

The commission reached a stalemate in June, and then on Wednesday, they decided unanimously to delay the decision again to leave room for more tribal consultation.

Cummings says he is not surprised by the delay. But even if the commission lists the western Joshua tree next year, he doubts the fight will end there either.

“If they vote to protect Joshua trees, various business interests will undoubtedly sue, trying to overturn that protection. And conversely, if the commission votes against protecting Joshua trees, I will sue, attempting to overturn that unlawful, unscientific decision. So the future of the species is likely to be contested for the next few years,” he says.

For now, the Joshua tree has temporary protection, since it is a candidate species for CESA. The commission will revisit the decision in February 2023.

There was a car that someone would love to own or have in their dreams. People would take photos of a favorite car or just stand and admire it.

There were so many different cars to like: sedans, pick-ups, convertibles, mini vehicles, station wagons, muscle cars, sports cars of all kinds, and even a hearse. There was an Indianapolis Indy 500 pace car from 1998. Sponsors chose their own choice of car for an award. Healthy Winter Habits to Maintain Health

Another cough and cold season call for healthy preparation, and while there may not be a foolproof plan for escaping pesky germs, taking preventive steps and practicing self-care can help protect your health.

Make handwashing a priority. Preventive measures like washing your hands often can significantly lower your odds of getting sick. In fact, handwashing is such a powerful tool against germs that the Centers for Disease Control and Prevention compared it to a “do-it-yourself vaccine.” Wash regularly with soap and water for about 20 seconds, especially when handling food, caring for someone sick, or after using the restroom.

Make overall wellness a way of life. Adopting healthy everyday habits means your body is in better condition to fight off potential attacks by germs and combat an illness more effectively if you do get sick. For example, a wellbalanced diet with moderate portions from each major

food group can help ensure you get the nutrition and nutrients your body needs. In addition, staying physically active can help promote a more robust immune system. Getting enough sleep and making sure you’re drinking enough water can also ensure your body is ready for whatever the season brings.

Stock up on necessary supplies. If you get sick, the best place for you is at home, where you can nurse yourself back to health. Originally from the Windy City of Chicago, Jack was the son of John A. Lyons, a Chicago police officer, and Mary S. Lyons, a long-time employee of American Airlines. An avid hockey fan and movie fan, Jack enlisted in the Air Force, where he served as an air traffic controller during the Korean war. In 1953, he was posted to a British Air Force Base, and through friends, he met his wife, Christina, a London native. After a twoyear courtship, the two were married in London and returned to Chicago to start their family.

In April 1956, their only child Lisa was born. The family moved to Los Angeles in 1961, joining his parents and younger brother, Jerry, who had already moved west. Once there, Jack found his true calling when he joined the local community theater, the Kentwood Players.

He initially dreamed of being an actor but soon realized he was a far better producer and public relations man for the oldest community theater in Los Angeles. In the mid1960s, Jack enrolled at Loyola University to earn a Bachelor’s degree in Communications. It was there that he met his second wife, Jeannette. After graduation, he worked for acclaimed documentary producer David Wolper. His filmmaking skills led to a job at Northrop Grumman, where he worked as an industrial filmmaker until the 1980s.

He subsequently became Vice President of Corporate Communications and parlayed his skills into a regional manager role with Commuter Transportation Services in Los Angeles. In 1982, Jack and Jeannette moved from Culver City, California, to Desert Hot Springs’ Mission Lakes Country Club. Both J & J ( as their friends called them) were avid golfers and awardwinning theater community members in the Coachella Valley. They began leading golf tours to Canada and the

UK for friends and neighbors at Mission Lakes, but Jack always longed to combine his love of performing and theater in a meaningful way. At age 74, he finally realized his dream of working as an on-air personality in the Palm Springs area. He worked with local good news radio host Bonnie Gilgallon and then provided Both stages. He eventually began running film and theater reviews for the Desert Star Weekly newspaper and online for Desert Local News. He was an active American Theater Critics Association member and persuaded his daughter Lisa to join. She encouraged him to start his own social media outlet, and together they created their blog, Lyons Views, News, and Reviews, showcasing their writing talents.

After Jeanette’s passing in 2014, Jack slowed down but continued to write, mentor young people (which he was very good at), and continued to entertain people with his great stories, in which he played all the parts, of course!

In accordance with his

wishes, Jack was cremated with no funeral plans. Instead, he will be laid to rest along with his loving wife at the Riverside National Cemetery. However, his friends at the Desert Theatre League plan a Celebration of Life for Jack in the next few months. Details will be shared when finalized.

Jack is survived by his

only daughter Lisa, his niece Diana Bell of Manhattan Beach, his niece Mary Margaret Dopp (Bill) of Milwaukee, Wisconsin, and his cousins Steven McAvoy (Anita) of Lake Zurich, Illinois. His parents, his younger brother Jerry Lyons, and his nephew David Lyons preceded him in death.

Supreme Court to Mull Ending Affirmative Action in Higher Ed

The Supreme Court will hear oral arguments Monday in a pair of cases that could spell the end of affirmative action on American college campuses.

Activist Edward Blum with the group Students for Fair Admissions, sued Harvard University and the University of North Carolina, arguing that raceconscious admissions criteria unconstitutionally discriminate against Asian American students.

Thomas Saenz, president and general counsel for the Mexican American Legal Defense and Educational Fund, a Latino civil rights organization, said he expects the court to rule against affirmative action. But he suggested colleges can still address the problem from a different angle.

“Among the raceneutral remedies that we should expect universities to look at are eliminating selection criteria that have demonstrated an unjustified discriminatory effect on Latino and Black students,” Saenz contended. “These are things like standardized tests and even things like teacher recommendations.”

California banned

preferential treatment in education and government in 1996 with Proposition 209.

Since then, the share of Black, Native American, and Latino students in public universities has fallen. For example, Latinos made up 59% of the state’s high school graduates in 2019 but only 29% of that year’s freshman class at the University of California.

Sally Chen, education equity program manager for the group Chinese for Affirmative Action, said Blum is no friend of students of color.

“He is not calling for anti-bias training, support for professors of color, funding cultural centers, or anything that really supports students of color,” Chen pointed out. “He’s advancing Asian Americans as a front in this conservative rightwing attack on civil rights.”

Private colleges and universities in California were not covered by Proposition 209. As a result, they can still use race-conscious admissions policies, but it could change if the Supreme Court rules against Harvard University, a private institution.
