you can't, unless it's a non ops.(correct me if i am mistaken)
Pretty much the seller is responsible for smog(3 months from date of sale) no matter what the bill of sales said, it doesn't matter if it's listed for "as it" "no warranty" "can't pass smog", it's the seller's responsibility in CA. Ran into a similar problem couple years back when we sold a beater for burger money. 83 still not old enough for smog exp, right?

If its stated on the bill of sale or a Statement of Facts form from DMV you can sell the car under the buyers consent and responsibility.
Buying from a private party has no laws or rules.. So as long as its stated and you acknowledge that you can buy it..
